This Privacy Policy describes the privacy practices of Isla Porter, Inc., (collectively, "Isla Porter," "we", "us"; or "our") and how we handle personal information that we collect through our digital properties that link to this Privacy Policy, including our website at https://www.islaporter.com/ (collectively, the "Service"), as well as through social media, our marketing activities, our live events and other activities described in this Privacy Policy.
Personal information we collect
Information you provide to us. The Personal Information we may collect on or through the Service or otherwise includes:
- Business, for the purpose of the California Consumer Privacy Act (CCPA), refers to us as the legal entity that collects Consumers’ Personal Information and determines the purposes and means of the processing of Consumers’ Personal Information, or on behalf of which such information is collected and that alone, or jointly with others, determines the purposes and means of the processing of consumers’ Personal Information, that does business in the State of California.
- Communications that we exchange with you, including when you contact us with questions or feedback, through the Service, social media, or otherwise, and communications between you and our contractors via our Service.
- Consumer, for the purpose of the CCPA, means a natural person who is a California resident. A resident, as defined in the law, includes (1) every individual who is in the USA for other than a temporary or transitory purpose, and (2) every individual who is domiciled in the USA who is outside the USA for a temporary or transitory purpose.
- Contact data, such as your first and last name, email address, billing and mailing addresses, professional title and company name, and phone number.
- Contractor data including personal data that you may provide to us, such as contact data, and licensing and insurance information for your business.
- Marketing data, such as your preferences for receiving our marketing communications and details about your engagement with them.
- Other personal information not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection.
- Payment or Transactional data, such as information relating to or needed to complete your orders and/or payments on or through the Service (including payment card information and billing information), and your purchase history.
- Personal Information is any information that relates to an identified or identifiable individual. For the purposes of the CCPA Personal Information means any information that identifies, relates to, describes or is capable of being associated with, or could reasonably be linked, directly or indirectly, with you.
- Profile data, such as the username and password that you may set to establish an online account with us, biographical details, and any other personal information that you add to your account profile.
- Promotional data, including information you share when you enter a promotion or complete a survey. renovation services, such as contact data, information about your residence or building.
- Sale, for the purpose of the CCPA, means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a Consumer’s Personal Information to another business or a third party for monetary or other valuable consideration.
- Sensitive Personal Information for the purpose of the CCPA means: (1) Personal Information that reveals (A) a Consumer's social security, driver's license, state identification card, or passport number; (B) a Consumer's account log-In, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; (C) a Consumer's precise geolocation; (D) a Consumer's racial or ethnic origin, religious or philosophical beliefs, or union membership; (E) the contents of a Consumer's mail, email and text messages, unless the business is the intended recipient of the communication; (F) a Consumer's genetic data; and (2)(A) the processing of biometric information for the purpose of uniquely identifying a Consumer; (B) personal information collected and analyzed concerning a Consumer's health; or (C) Personal Information collected and analyzed concerning a Consumer's sex life or sexual orientation. Sensitive Personal Information that is "publicly available" pursuant to paragraph (2) of subdivision (v) of Section 1798.140 shall not be considered Sensitive Personal Information or Personal Information.
- Service Provider means any natural or legal person who processes the data on behalf of Isla Porter. It refers to third-party companies or individuals employed by Isla Porter to facilitate the Service, to provide the Service on behalf of Isla Porter, to perform services related to the Services or to assist Isla Porter in analyzing how the Services are used.
- Services refers to the Site and any social media, marketing activities, live events, and other activities described in this Privacy Policy related to the sale of our Products.
- User-generated content, such as photos, videos, product reviews and feedback, comments, and other content or information that you generate, transmit, or otherwise make available on the Service, as well as associated metadata.
Third-party sources. We may combine personal information we receive from you with personal information we obtain from other sources, such as:
- Public sources, such as social media platforms and other publicly available sources.
- Data providers, such as information services and data licensors that provide demographic and other information and background check providers.
- Marketing partners, such as joint marketing partners and event co-sponsors.
Automatic data collection. We, our service providers, and our business partners may automatically log information about you, your computer or mobile device, and your interaction over time with the Service, our communications and other online services, such as:
- Device data, such as your IP address, unique identifiers (including identifiers used for advertising purposes), and general location information such as city, state or geographic area.
- Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, the website you visited before browsing to the Service, navigation paths between pages or screens, information about your activity on a page or screen, access times and duration of access, and whether you have opened our marketing emails or clicked links within them.
- Precise geolocation data when you authorize the Service to access your device’s location.
Cookies and similar technologies. Like many online services, we use the following technologies to collect personal information:
- Cookies, which are text files that websites store on a visitor’s device to uniquely identify the visitor’s browser or to store information or settings in the browser for the purpose of helping you navigate between pages efficiently, remembering your preferences, enabling functionality, helping us understand user activity and patterns, and facilitating analytics and online advertising.
- Local storage technologies, like HTML5 and Flash, which provide cookie-equivalent functionality but can store larger amounts of data, including on your device outside of your browser in connection with specific applications.
- Web beacons, also known as pixel tags or clear GIFs, which are used to demonstrate that a webpage or email address was accessed or opened, or that certain content was viewed or clicked.
- Software development kits, or SDKs, which are used to incorporate third party computer code into our app that allows our third party service providers or advertising partners to collect user data directly from the app for a variety of purposes, including to provide us with analytics regarding the use of the app, to integrate with social media, add features or functionality to our app, or to facilitate online advertising.

Data about others. Users of the Service may have the opportunity to refer friends or other contacts to us and share their contact information with us. Please do not refer someone to us or share their contact information with us unless you have their permission to do so.
How we use your personal information
We may use your personal information for the following purposes or as otherwise described at the time of collection:
Service delivery. We may use your personal information to:
- provide, operate and improve the Service and our business;
- process your payments and complete transactions with you;
- establish and maintain your user profile on the Service;

As part of these activities, we may create aggregated, de-identified or other anonymous data from personal information we collect. We make personal information into anonymous data by removing information that makes the data personally identifiable to you. We may use this anonymous data and share it with third parties for our lawful business purposes, including to analyze and improve the Service and promote our business.
Aggregated Anonymous Data. We may aggregate data you post, provide or generate in your use of our Services and any associated services, along with other learnings, logs, and data regarding your use of our Services so that results are non-personally identifiable with respect to You ("Aggregated Anonymous Data"). Isla Porter has the right to generate Aggregate Anonymous Data and that Aggregate Anonymous Data is the property of Isla Porter, which Isla Porter may use for any business purpose (including without limitation to develop and improve Isla Porter products and services and to create and distribute reports and other materials).
Marketing and advertising. We, our service providers and our third-party advertising partners may collect and use your personal information for marketing and advertising purposes:
- Direct marketing. We may send you Isla Porter-related or other direct marketing communications as permitted by law. You may opt-out of our marketing communications as described in the "Opt-out of marketing communications" section below.
- Interest-based advertising. We may engage third-party advertising companies and social media companies to display ads on our Service and other online services. These companies may use cookies and similar technologies to collect information about your interaction (including the data described in the automatic data collection section above) over time across the Service, our communications and other online services, and use that information to serve online ads that they think will interest you. This is called interest-based advertising. We may also share information about our users with these companies to facilitate interest-based advertising to those or similar users on other online platforms.
SMS Marketing and Support, which may include using your personal information to:
- send you text notifications for your order (including abandoned checkout reminders), text marketing offers, transactional texts, and requests for reviews. We use information stored in a cookie to save information about your cart for future use and determine whether it has been abandoned;
- share opt-in data with our messaging partners and service providers, for the sole purpose of enabling and operating our text messaging program.
Compliance and protection. We may use your personal information to:
- comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities;
- protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims);

Retention. We generally retain personal information to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements, to establish or defend legal claims, or for fraud prevention purposes. To determine the appropriate retention period for personal information, we may consider factors such as the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.
When we no longer require the personal information we have collected about you, we may either delete it, anonymize it, or isolate it from further processing.
How we share your personal information
We may share your personal information with the following parties and as otherwise described in this Privacy Policy or at the time of collection.
Affiliates. Our corporate parent, subsidiaries, and affiliates, for purposes consistent with this Privacy Policy.
Service providers. Third parties that provide services on our behalf or help us operate the Service or our business (such as hosting, information technology, customer support, email delivery, marketing, and website analytics).
Payment processors. Any payment card information you use to make a purchase for the Services is collected and processed directly by our payment processors, Shopify, which may use your payment data in accordance with their privacy policies. Advertising partners. Third-party advertising companies for the interest-based advertising purposes described above.
Professional advisors. Professional advisors, such as lawyers, auditors, bankers and insurers, where necessary in the course of the professional services that they render to us.
Authorities and others. Law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for the compliance and protection purposes described above.
Business transferees. Acquirers and other relevant participants in business transactions (or negotiations and diligence for such transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale or other disposition of all or any portion of the business or assets of, or equity interests in, Isla Porter or our affiliates (including, in connection with a bankruptcy or similar proceedings).
Contractors, other users and the public. Profile data and other personal information may be shared with or viewable to contractors, other users of the Services, and the public, and you agree that Isla Porter may share such data as necessary to allow such third parties to provide you with requested products and services, including sharing your personal information with contractors in connection with soliciting contractors to provide services to you. You may also be able to submit content to the Service (such as comments, reviews, photos, and videos), and we may display your information (such as your picture, first name, and possibly your last initial) along with the content you submit. This information can be seen, collected and used by others, including being cached, copied, screen captured or stored elsewhere by others (e.g., search engines), and we are not responsible for any such use of information.
Your choices

Access or update your information. If you have registered for a Service account with us, you may review and update certain account information by logging into the account.
Opt-out of marketing communications. Please note that if you choose to opt-out of marketing-related emails, you may continue to receive service-related and other non-marketing emails. Please note that we also may work with companies that offer their own opt-out mechanisms and may not participate in the opt-out mechanisms that we linked to above.

Declining to provide information. We need to collect personal information to provide certain services. If you do not provide the information we identify as required or mandatory, we may not be able to provide those services.

We employ a number of technical, organizational and physical safeguards designed to protect the personal information we collect. However, security risk is inherent in all internet and information technologies, and we cannot guarantee the security of your personal information.
International data transfer
We are headquartered in the United States and provide our Services to persons located in the United States and Canada.
Children
The Service is not intended for use by children under 18 years of age. If we learn that we have collected personal information through the Service from a child under 18 without the consent of the child’s parent or guardian as required by law, we will delete it. We encourage parents or guardians with concerns to contact us.
Changes to this Privacy Policy
We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on the Service. If required by law we will also provide notification of changes in another way that we believe is reasonably likely to reach you, such as via email or another manner through the Service. Any modifications to this Privacy Policy will be effective upon our posting the modified version (or as otherwise indicated at the time of posting). State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information.

Exercising your right to opt-out of the "sale" or "sharing" of your Personal Information. Like many companies, we may use services that help deliver interest-based ads to you. The State Privacy Laws may classify our use of some of these services as "selling" or "sharing" your Personal Information to or with the advertising partners that provide the services. You can update your preferences to opt-out of tracking for targeted advertising purposes or other sales of Personal Information by clicking on the "Do Not Sell or Share My Personal Information" link at the bottom of the Site. California residents can also turn on the Global Privacy Control (GPC) to opt out of the "sale" of your Personal Information for each participating browser system that you use. Verification of Identity; Authorized agents. We may need to verify your identity in order to process your information, request to know how we process your Personal Information, to whom we have disclosed your Personal Information, your access, appeal, correction, deletion, or other requests relating to your Personal Information, and confirm your residency. To verify your identity, we may require government identification, a declaration under penalty of perjury, or other information, where permitted by law.
Under some State Privacy Laws, you may enable an authorized agent to make a request on your behalf. However, we may need to verify your authorized agent's identity and authority to act on your behalf. We may require a copy of a valid power of attorney given to your authorized agent pursuant to applicable law. If you have not provided your agent with such a power of attorney, we may ask you to take additional steps permitted by law to verify that your request is authorized, such as by providing your agent with written and signed permission to exercise your State Privacy Laws rights on your behalf, the information we request to verify your identity, and confirmation that you have given the authorized agent permission to submit the request.
