Installation Guarantee
Warranty: Isla Porter cabinetry is crafted to stand the test of time, and we stand behind that. We provide a limited lifetime warranty that our products will be free of defects in the materials and workmanship under normal use for as long as they are owned by the original retail purchaser and the Customer complies with the terms of this warranty. The warranty is non-transferable and applies only to the original residential installation. What does this warranty cover? During the warranty period, Isla Porter will repair or replace, at its option any Isla Porter Cabinetry product or part thereof that is covered by this warranty. Isla Porter is constantly changing and improving its product lines, and as such, exact replacements may not be available. If a warranty claim is filed after an Isla Porter kitchen product becomes obsolete or discontinues, Isla Porter will replace the affected component with a new component of the same or similar style based on availability. While we always do our best to match finishes, as products wear or patina naturally changes, it becomes challenging to replicate the exact tone with new production. If a product or component(s) are replaced under this warranty, Isla Porter does not guarantee that the finish of the replacement products or components will exactly match the grain, finish or appearance of the products or components in the residential application. This is due to the changes that occur during the wood’s natural aging process , affecting its color and grain and the inherent colorfastness in paint products. What this warranty does NOT cover: The following are not covered and will void the warranty for the product: (i) damage or defects caused by misuse, vandalism, abuse, negligence, alteration, or abnormal use; (ii) accidental damage or damage in transit prior to or during installation; or (iii) effects of exposure to sunlight, extreme temperature, moisture, or dryness levels. If a product must be stored, it should be covered and store in a humidity- and temperature-controlled environment away from direct sunlight); (iv) damage caused by excessive loads or stresses; (v) unauthorized disassembly repair or modification, (vi) damage caused by Acts of God, including natural disasters; (vi) normal incidental deterioration such as nicks, scratches, abrasions and natural aging whether resulting from the effects of normal wear and tear or abnormal use; (vii) damage caused by use of abrasive cleaning or chemicals; (viii) water damage, spills and stains, or (ix) products not purchased, or installed, in the United States or Canada. In addition, the following are not covered by this warranty: - Any Isla Porter products or parts that have been modified, including the use of non-Isla Porter parts. - All products altered or damaged during installation, including use or storage of a product not in accordance with our storage instructions. Installation by a professional contractor is recommended. - Claims for which no original receipt and proof of original ownership is provided. - Countertops, Flooring, Appliances, Decorative Hardware, Fixtures or any other non-Isla Porter cabinetry product related to your space or project. - Labor related to the removal, installation, or shipping, freight or other charges incurred in repairing or replacing any product under this warranty. - Uses of this product in an outside or damp environment. - Unfinished cabinetry. - Component parts included in the products that were not manufactured by Isla Porter. The warranties, if any, on those components are limited to the warranties provided by the original component manufacturer . Natural woods may vary in color and characteristics and exhibit subtle changes as they age, resulting in cabinet colors and finishes lightening, darkening, or changing over time. Also, humidity and temperature changes can cause wood to expand and contract. This can result in breaks in the base or finish coat in the joint areas. Sunlight, smoke, household cleaners and other environmental conditions may also affect the color and integrity of your finish over time. These are all normal changes that occur in a product as a consequence of the material from which it is made and the environment in which it is used. These changes are not covered by this warranty. At the time of installation doors may warp a ¼” or less, which is normal. The doors must be allowed to set which will take two (2) seasons (e.g., spring and summer). Typically, the door will return to its normal flat state after two seasons once the product acclimates to the installed environment. If the warpage still exists after two seasons, contact us at customersupport@islaporter.com. Prior to requesting any replacement, please be sure that the problem is not due to an incorrect installation. To minimize warpage and moisture expansion of wood products, Isla Porter cabinetry and related products should be stored and maintained in a climate controlled environment before installation that avoids temperature extremes (hot or cold) and extremely high or low humidity conditions. Isla Porter will not warranty products stored or installed in an uncontrolled environment. All claims under this warranty must include a reasonable description of the defect and the date and place of purchase. A copy of the original purchaser’s dated receipt must be submitted with all claims to preserve the rights under this warranty. Isla Porter reserves the right to inspect the claimed defective product prior to any replacements or repairs being made to verify that the terms of this warranty were complied with at all times. If a product is replaced or repaired by Isla Porter under a warranty claim and it is subsequently determined that the product or damage was not covered by this warranty, Isla Porter reserves the right to seek reimbursement of the cost of the replacement or repair. DISCLAIMER OF WARRANTIES To the maximum extent permitted by applicable law: THIS LIMITED WARRANTY SETS FORTH THE ONLY WARRANTIES EXTENDED BY ISLA PORTER FOR THE CABINETRY PRODUCTS AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED IN CLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND CONSTITUTES THE ENTIRE LIABILITY OF ISLA PORTER. TO THE EXTENT ANY IMPLIED WARRANTIES MAY NONETHELESS EXIST BY OPERATIONS OF LAW, SUCH WARRANTIES ARE LIMITED TO THE EXTENT PROVIDED BY LAW. LIMITATION OF LIABILITY THIS WARARNTY DOES NOT COVER AND ISLA PORTER LLC SHALL NOT BE LIABLE FOR ANY AND ALL INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, LOSS OF USE, LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF GOODWILL, CLAIMS OF EMOTIONAL DISTRESS, RETURN SHIPPING COSTS, SERVICE AND LABOR COSTS, AND EXPENSES RELATED TO UNINSTALLING OR INSTALLING ANY MATERIAL OR PARTS (INCLUDING REPLACEMENT PARTS), WHETHER ARISING OUT OF BREACH OF WARRANTY, BREACH OF CONTRACT, NEGLIGENCE, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ISLA PORTER HAS BEEN ADVISED OF THE POSSIBILITY THEREOF. ISLA PORTER’S TOTAL LIABILITY UNDER THIS AGREEMENT SHALL BE REPLACEMENT OR REPAIR OR REFUND OF THE PURCHASE PRICE FOR THE IMPACTED PRODUCT. IN NO EVENT WILL ISLA PORTER ENTIRE LIABILITY EXCEED THE LESSER OF THE PURCHASE PRICE OF THE PRODUCT WARRANTED HEREUNDER, OR THE NON-CONFORMING PORTION OF THE PRODUCT. This warranty excludes all industrial, commercial and business usage, whose purchasers are hereby extended a one year limited warranty from the date of purchase, with all other terms of this warranty applying except the duration of the warranty. Some provinces and states do not allow the exclusion or limitations of incidental or consequential damages, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary in other states and provinces. This warranty is not transferable. How Do You Make A Warranty Claim? Withing thirty (30) days of discovering a defect, please contact us directly at customersupport@islaporter.com. Depending on the nature of the issue. we may arrange for an inspection of the product. Our service department may request samples or pictures of the defective product for evaluation. Do not return any product until our Customer support team provides instructions and requests you to ship the product for evaluation. In the event that we determine that a product was not defective or that any defect is not covered by this warranty, Isla Porter reserves the right to deny replacement or repair of the product unless the Customer make an arrangement with Isla Porter to pay for the costs of replacement or repair. ANY PRODUCTS ALTERED OR DAMAGED DURING INSTALLATION ARE NOT RETURNABLE AND WILL VOID THIS AND ALL WARRANTIES.
